Information on DUI Treatment for First-time Offenders

Information on driving under the influence (DUI/DWI) and the penalties involved.

Driving Under the Influence DUI Accident

It’s a widely known fact that driving under the influence poses grave risk to public safety. And yet, tens of thousands of people still lose their lives in a DUI/DWI-related incident every year. And now with marijuana becoming legal state by state nationwide, that element can potentially exacerbate the problem.

While governments place age restrictions on the purchase of alcohol and marijuana, we all very well know that when an underage consumer wants it they will somehow find a way. Regardless, however, the DUI epidemic is just as prevelent among of age adults as it is among the underage, if not more.

To minimize cases of driving under the influence, the government and law enforcement agencies are not only imposing strict DUI enforcement and punishments all over the country, but also adding DUI education and treatment as a consequence to DUI offenses as part of a long-term solution, especially among first-time DUI offenders. Persons arrested for DUI may take DUI classes in person or through a DMV-approved DUI class online.

If you’ve been arrested for drunk driving for the first time, here are some facts about DUI treatments that you might want to know.

First-time DUI offenders are often court-mandated to go to DUI school.

Many states impose mandatory alcohol (and drug) education, among other penalties, for a DUI related offenses. This means that those arrested for DUI are, quite often, required to attend a DUI education and treatment program by the court or the state’s Department of Motor Vehicles.

In many states, the punishments that accompany a first-time DUI offense can vary based on your BAC level at the time of the arrest, which is assessed in three tiers:

General Impairment: 0.08% – 0.99% BAC
High BAC: 0.10% – 0.159% BAC
Highest BAC: 0.16% BAC or higher

Each tier is subject to fines and penalties, but all of them include alcohol highway safety courses and substance abuse treatments (usually for High BAC and Highest BAC offenses), and loss of driving priviledges.

DUI education programs cover different levels of substance abuse treatments.

DUI programs focus on educating people about substance abuse and the consequences of driving under the influence of drugs and alcohol. They aim to help participants take responsibility for their alcohol/drug use to avoid relapses and DUI incidents in the future.

Depending on the results of your assessment, your substance abuse treatment may include:

● Individualized counselling
● Group meetings with a therapist
● Outpatient substance abuse treatment
● Inpatient substance abuse treatment
● Attendance to Alcoholic Anonymous
● Medication-assisted treatment
● Dual diagnosis treatments (if substance abuse and mental illness coexist)

The length of the recovery program can vary from offender to offender.

DUI treatments typically begin with an evaluation to determine whether you meet the criteria for substance abuse disorder. The court will decide the level, frequency, and length of your treatment based on the evaluation. For first-time offenders can last from one or two sessions to 36 hours in a span of 12 weeks. However, some offenders may be required long-term treatment, as needed.

DUI treatment (and repercussions) can help prevent repeated DUI offenses.

There’s a high probability for a first DUI offense to be followed by another.

According to the National Institute on Drug Abuse, those who are referred to the program by the legal system are likely to finish their programs and generally have good treatment outcomes. Thus, learning to manage drinking and substance abuse problems through DUI education and treatment could be the factor that tips the scales towards avoiding repeat offenses.

DUI school, in general, should not be viewed as punishment, but rather as an opportunity to break the cycle of abuse and discover underlying issues or conditions that led to it.

Most participants enroll in addiction awareness and substance abuse treatment after being arrested for DUI, but these programs are actually available for anyone who wishes to put a lid on or avoid developing an addiction. They can help you gain control over your substance or alcohol use, so it does not interfere with your daily life.

Addiction Recovery Using Sober Living vs. A Treatment Center

Some addicts get sober by way of a sober living home (halfway house, recovery housing) and some need a drug rehab center. Which is the right choice?

Addiction recovery in sober living vs. a drug treatment center
Getting sober from drugs and alcohol is a unique experience for each individual. Some people can literally put it down and go about their lives as if it was never really a problem, though this is quite uncommon for the real drug addict (alcohol is a drug too). People in this category are generally considered to be drug “abusers” rather than actual “addicts,” and though they still have the power of choice, it usually takes a varying amount of negative consequences, ultimatums, threats, feelings of impending doom, etc. for them to finally stop.

With the true addict, there often times needs to be an additional force on their side in order to create physical seperation. This is where a sober living home (aka. recovery residence or halfway house) or an addiction treatment environment comes into play. There are various potential hurdles commonly experienced in early sobriety, the first of which being the decision to get sober and subsequent follow through.

For many addicts & alcoholics, that initial separation during the first 30, 60 90 days or so is simply impossible to persevere through without some additional outside assistance. This is especially common with drugs like crack-cocaine which have a very powerful grab and euphoric recall. People in this category will undoubtedly improve their chances for success in recovery if choosing to enter an addiction treatment program, or at least a structured or semi-structured sober living residence. Both options provide for more personal accountability and oversight, though the rehab option is definitely more comprehensive in this regard.

Here are some of the common recovery approaches for those who cannot simply stop using drugs or alcohol on their own:

  • Structured or semi-structured sober living/recovery home
  • Sober living residence + outpatient treatment (sometimes referred as PHP treatment)
  • Short-term drug rehab program (30 days or less)
  • Long-term treatment program (60 days to 18 months)

Going the route of an addiction treatment center is almost always going to provide a far more comprehensive approach, in terms of clinical services. These include such things as; group & private therapy, other therapy types (i.e., CBT, DBT, EMDR, equine, etc.), psychiatric & medication management), and more.

As compared to a halfway house or sober living residence, a facility that provides residential or inpatient treatment will offer much more structure as well as 24/7 oversight. This is important because, those whose drug addiction has taken over will often times feel overcome by the urge to use, especially during early recovery.  While oversight can be a big plus in helping these individuals get through these periods, even the most highly structured recovery residences cannot provide the same level of oversight as that of inpatient treatment.

Whether you go the route of a halfway house or sober living home, or some variation of addiction treatment, your success is ultimately in your own hands. The more willing a person is to change, the more likely they are to achieve success. The Herbert House | A Los Angeles Pioneer in Recovery Housing

It was the early 1990’s and the need for sober living housing and addiction treatment aftercare was greater than ever before.

I cannot tell you how many times in my own early sobriety that on the way from an AA or NA meeting, all I could think about was going to get high. After all, I was doing good, I was working hard at recovery and at rebuilding my life. My mind would try to convince me that I deserved it, I earned it, and not only that but this time I was going to find a way to manage it so that I can do drugs and simultaneously lead an honest, wholesome life. It made perfect sense in my newly sober mind… Oh how nice it would have been to have the support and structure of a sober living home environment.

The residential type aftercare concept began here in Southern California. The terminology on the west coast was primarily “sober living home,” though it broadened over time into descriptors like “recovery homes/housing,” and “halfway or 3/4 houses,” seen more so in other parts of the country. Regardless of the term used however, there was a profound need for some type of transitional residence that would act as a step-down between treatment and living alone.

Throughout the late 80’s and early 90’s I had become plugged in with a number of drug rehabs throughout Southern California. As such, I had quite a few opportunities to speak with therapists at these facilities, all of whom were in agreement that some type of transitional housing would be of great benefit to addicts and alcoholics new in recovery. Soon after, in 1995 to be exact, Herbert House Sober Living was born..

Initially, as we were essentially inventing the sober living model from day to day, we catered to both men and women. I knew two things for sure, that I wanted to provide a nice, clean, upscale environment, and that I wanted to effectively address the same early recovery mental obsessions that I was plagued with.

As the sober living/recovery housing industry slowly took root, I was fortunate to have been a part of the Los Angeles County Sober Living Coalition. We felt it was very important that there be a certain standard by which reputable sober livings operate. This became necessary since, unfortunately, there were a number of homes throughout LA County that did not operate by the highest standards.

Herbert House has gone through a number of changes over the past 25 years, but one thing that will never change is our comittment to the client’s recovery.
